General Terms and Conditions (AGB)

Please read these terms and conditions carefully. By using our services, you agree to these terms and conditions.

1. scope of application

These GTC apply to all business relationships between Echte Lizenz (hereinafter "Provider") and customers (hereinafter "Client") in the version valid at the time the contract is concluded.

2. conclusion of contract

Offers from the provider are non-binding. A contract is only concluded by express order confirmation via WhatsApp or e-mail or by delivery of the agreed service.

3. scope of services

The scope of services depends on the individual agreement. Descriptions on the website are for general information purposes only and do not constitute a binding assurance of additional properties.

4. prices & payment

4.1 All prices are final prices in EUR/CHF (depending on the service) and are exclusive of statutory taxes, unless otherwise stated.
4.2 Payment shall be made as agreed by bank transfer, cryptocurrency, or alternative payment methods that are confirmed in advance. Payments are to be made without deductions.
4.3 In the event of late payment, we reserve the right to charge interest on arrears at the statutory rate and to suspend performance until payment has been received.

5. delivery / performance

5.1 Delivery and processing times are stated as non-binding periods unless expressly agreed as binding.
5.2 Delays that are beyond our control shall not entitle us to assert claims for damages, except in cases of gross negligence or intent.

6. revocation / withdrawal

6.1 Consumers within the meaning of distance selling law have a statutory right of withdrawal (see data protection declaration/cancellation policy). Services begin with express consent and may therefore be excluded from the right of withdrawal.
6.2 In the event of justified withdrawal by the client, we reserve the right to claim reasonable compensation for services already rendered.

7. warranty

7.1 The statutory warranty regulations shall apply. Obvious defects must be reported in writing immediately, but at the latest within 7 days of performance.
7.2 In the event of a justified complaint, we shall, at our discretion, repair or replace the goods. Further claims are excluded unless otherwise stipulated by mandatory statutory provisions.

8. liability

8.1 The Provider shall only be liable for slight negligence in the event of a breach of material contractual obligations (cardinal obligations). In this case, liability is limited to the typically foreseeable damage.
8.2 Liability for intent and gross negligence remains unaffected. Liability under the Product Liability Act also remains unaffected.
8.3 Liability for loss of profit, indirect damage or consequential damage is excluded to the extent permitted by law.

9. confidentiality & data protection

9.1 We treat your data confidentially and observe the applicable statutory data protection regulations. For details, please refer to our Privacy policy.
9.2 Clients undertake not to publish any information about internal processes or third parties.

10. copyrights & rights of use

The content, texts, images and other materials on the website are protected by copyright. Use, reproduction or distribution without written consent is prohibited.

11. final provisions

11.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods, provided that the client is a merchant, a legal entity under public law or a special fund under public law.
11.2 Should individual provisions of these GTC be invalid in whole or in part, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid provision that comes closest to the economic purpose.
